Jack Smith deposition confirms they would have convicted Trump

SUMMARY

Jack Smith's congressional testimony reveals critical insights into the prosecution of Donald Trump. In 2023, 85% of federal indictments resulted in guilty pleas, while 80% of cases that went to trial ended in convictions. Under the Trump administration, the Department of Justice (DOJ) has experienced a 21% dismissal rate, significantly higher than the 1% dismissal rate under Biden's DOJ in 2022. This disparity suggests a potential politicization of the DOJ, impacting the quality and substance of cases presented.

USEFUL FOR

Political analysts, legal professionals, and anyone interested in the dynamics of federal prosecutions and the influence of political contexts on judicial outcomes.

Of course a prosecutor who has taken a case to court, expects to get a guilty conviction.

In 2023, of Federal indictments, 85% of cases didn't go to court because the accused pled guilty.
Of those that didn't pled guilty 80% of those that went to court were found guilty.

I don't know what Jack Smith's record is in regards to percentage either pled or found guilty, but I would guess it is high.

Under Trump 2.0 DOJ, I think is having a much higher failure rate. They are having a 21% dismissal rate, I think this is before the case is properly presented in court, and is because the case is so poorly presented, or lacks substance that it is quickly thrown out. In comparison, under Biden's DOJ in 2022 they had a 1% dismissal.
This could be an indicator of a politicised DOJ making political cases to please Trump rather than ones based on substance.

But in saying all this. Who knows what would have happened with the Jack Smith case. The conservative majority Supreme Court have appeared to be bending over backwards to please Trump. Nobody predicted they would give the president immunity from the law in "official" acts. Which means since pardons are an official act, it is now legal for the president to sell off pardons by accepting payments (bribes).
